Virginia retailers evaluating hemp products should begin with the finished package, not a sales sheet. As of August 15, 2026, Virginia limits an industrial-hemp extract or hemp-derived cannabinoid product offered for retail sale to no more than 2 mg total THC in the entire package. Virginia also repealed the former 25:1 CBD-to-THC ratio allowance on that date.

Start with the intended sales channel
Tell a prospective supplier that the product is intended for Virginia general retail. Ask the supplier to identify the manufacturer, package size, ingredient list, cannabinoid amounts, lot number, and distribution chain. Do not assume that a product accepted in another state is eligible in Virginia.
Review the finished package and its COA together
- Match the product name, lot or batch number, package size, and test date.
- Confirm that the report states total THC for the whole package, or supplies enough validated information to calculate it.
- Review CBD, CBG, and CBN amounts against the label.
- Check the laboratory identity, methods, limits of detection and quantitation, and requested contaminant panels.
- Resolve missing pages, altered reports, mismatched lots, and unexplained units before ordering.
Check labels and commercial documents
Keep the final label artwork, COA, invoice, lot record, and supplier contact details together. Review required warnings, ingredient and allergen statements, net contents, cannabinoid declarations, and any age or packaging rules that apply to the particular product. Avoid disease, treatment, prevention, or cure claims.
Plan for the federal change
A stricter federal hemp-definition change is scheduled for November 12, 2026. It is scheduled to exclude final hemp-derived cannabinoid products containing more than 0.4 mg total THC per container. Buyers should ask suppliers how current and future lots will be assessed against that container-level threshold rather than relying only on a dry-weight percentage.
Use a conditional purchase process
Request samples or documents first, record who approved the file, and make any purchase commitment conditional on the final lot and package passing review. On receipt, quarantine discrepancies instead of placing the affected units on shelf. Recheck replacement lots rather than carrying approval forward indefinitely.
