A dated overview of Virginia package-level total-THC rules and the scheduled federal hemp-definition change for retail buyers.

This page describes a conservative general-retail hemp posture as reviewed on August 31, 2026. It does not describe a state-regulated marijuana distribution program, and this company does not represent that it holds a Virginia license to distribute products through such a program.

Virginia rule effective August 15, 2026

Virginia limits an industrial-hemp extract or hemp-derived cannabinoid product offered for retail sale to no more than 2 mg total THC per package. The former allowance based on a 25:1 CBD-to-THC ratio was repealed effective the same date. Buyers should therefore evaluate the complete retail package and should not rely on the repealed ratio or on a dry-weight percentage alone.

Scheduled federal change on November 12, 2026

A federal definition amendment is scheduled to exclude final hemp-derived cannabinoid products containing more than 0.4 mg total THC per container. Because this scheduled federal threshold is lower than Virginia's package ceiling, satisfying the Virginia number alone may not preserve federal hemp status after the federal effective date.

Reassess products when the formula, package count, net contents, manufacturer, laboratory method, or governing rule changes.

Label statements, warnings, age restrictions, packaging, food and cosmetic requirements, sampling methods, local rules, and agency interpretations can vary by product and may change. Retail eligibility is not established by inclusion in a website catalog, a supplier assurance, or a single ingredient report.
